Layout and copy on One Off Places web site
One Off Places Limited reserves the right to determine the final design, layout and functionality of the One Off Places web site.
One Off Places Limited reserves the right to edit copy or amend the layouts or photographs supplied, should it be considered necessary.
One Off Places Limited reserves the right, at its discretion, to amend and edit copy entered into the One Off Places online database by advertisers.
One Off Places Limited cannot be held responsible for any loss or damage resulting from the design or positioning of the properties or changes made to the photographs and copy submitted by the customer.
Accuracy
One Off Places cannot accept any legal responsibility for the accuracy of the advertisements, or any alleged breaches of contract on an advertiser's part and the advertiser indemnifies One Off Places Limited against all costs, expenses and losses arising out of a claim relating to the content of an advertisement.
Photographic materials
One Off Places Limited will make every effort to safeguard all materials supplied, and return them if required, but cannot be held responsible for any loss or damage, however caused, and for any loss or damage sustained. Every effort will be made to reproduce faithfully all advertisements submitted, but One Off Places Limited cannot be held responsible for any loss or damage or otherwise resulting from errors or omission.
Liability
One Off Places Limited does not warrant that the operation of the One Off Places site will be uninterrupted or error-free.
In no event shall One Off Places Limited be liable to the advertiser for any special, consequential, incidental or indirect damages, including lost profits.
Copyright
One Off Places Limited shall be entitled to reproduce part or whole of any photographic material supplied by the advertiser. One Off Places Limited claims copyright to the electronic images of the photographic material supplied by advertisers. It is the advertiser's responsibility to obtain reproduction permission for all photographic and other material used in their advertisements. The advertiser warrants that he is the owner of the copyright in such material or is authorised by the owner thereof to grant to One Off Places Limited the rights therein contained. One Off Places Limited cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers and the advertiser indemnifies One Off Places Limited against any action brought for breach of copyright or other rights from the use of such material supplied by the advertiser. One Off Places Limited cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers.
Hypertext links
One Off Places reserves the right to refuse hypertext links to, or addresses of, other web sites from advertisers' pages, and to remove links or web addresses without notice at our sole discretion.
Testimonials
Any entries in the testimonial section must be genuine comments from guests who have stayed at the property advertised. The e-mail address of the guests whose comments are given must be supplied on request.
Substitution of properties
An advertisement relates to a specific property. The property in an advertisement may not be substituted by another property. Each advertisement on the One Off Places site displays an individual property where people will spend their holidays - not examples of properties in a given area. Only one property can appear on each advertisement, unless it is a property with multiple rental units on the same site, and additional advertising units are purchased. One Off Places reserves the right to amend the copy or remove the advertisement, when more than one property is described in the advertisement.
Termination of advertising
If advertisers wish to have their advertisement removed from the Internet before the end of their subscription period, this will be done, but no refunds will be paid.
One Off Places Limited reserves the right to refuse any advertisement for the One Off Places web site, and will not be liable for any loss or expense in so doing.
If an advertiser attempts to enter unsuitable material into the One Off Places on-line database, or persistently misuses the on-line systems, One Off Places Limited reserves the right to remove the property from the One Off Places site. No refunds will be paid. If One Off Places Limited receives a complaint from a person who has rented an advertiser's property which One Off Places Limited, acting reasonably, consider is justified, or an advertiser knowingly double-books a property, or engages in any unacceptable practices or is in breach of its obligations to One Off Places Limited, then One Off Places Limited reserves the right to remove the property from the One Off Places web site without notice.
Authorization to Export Data
Advertiser acknowledges that in the sole discretion of One Off Places Limited, it may be necessary to keep a copy of the advertiser content and information outside the United Kingdom and the European Union. If such a copy is made it will be used only in the day to day operations of One Off Places Limited or its direct affiliates, and will not be shared with any third party.
Payment
Payment for advertising must be in British Pounds by Paypal, cheque, or bank transfer.
VAT (Value Added Tax)
Our services are defined for VAT purposes under paragraph 3, Schedule 5, VATA 1994. We are legally required to charge VAT at 17.5% to advertisers who are either resident in the UK; or private individuals resident in the EU. If you are resident outside the EU, VAT will not be charged as our services are outside the scope of UK VAT when provided to you. If you are an EU resident (except in the UK) and if you confirm that you are "In business", we will not charge UK VAT . "In business", for this purpose, means that you rent property on a regular basis to generate income.
EU residents (except UK)
By confirming you are "In business" you may be required to account for VAT in your local jurisdiction. Residency is interpreted for VAT purposes as the country where the individual has set up home and is in employment.
Legal jurisdiction
These terms and conditions are governed by English law and advertisers accept the exclusive jurisdiction of the English courts to rule on any disputes.
